The objective of the study is to understand the arguments that support the occupation of private rural lands, taking into account the occupations carried out by the Landless Rural Workers Movement (MST). It is a dialectical type of research. The relevant literature reveals that the historical trajectory of Brazil demonstrates the intense transformations that have taken place in society, as far as agrarian reform is concerned. On the one hand, we have the position that agrarian reform is important for the development performance of Brazil, especially in relation to the balance of the demographic problem, as well as in the productive scope, in what refers to improvements in the conditions partner and economic conditions of the poorest populations; on the other hand, the argument is maintained for the existence of a significant amount of unproductive land, and millions of landless families, or rural workers with little land, and survive in regions with minimal conditions of survival. Based on the apparent increase in movements, the landowners invaded the search of the Judiciary on the legitimacy of these invasions, generating divergences, due to the constitutional safeguard existing for the individuals of this movement, but also being disrespected. individual property right.pt_BR
