| dc.description.abstract | The present study aims to conduct a study about home teaching, also known as homeschooling, and its possible legal recognition in the Brazilian Legal Order. An investigation will be made into the origin of education in Brazil and a brief analysis of the treatment it received in the Brazilian constitutions and in the current infrastructural legislation, as well as the nature of social law inherent in education. Afterwards, an assessment will be made of homeschooling in American law, as well as the historical and cultural basis that allowed domestic education to flourish in that country. Finally, the main argument used by those who oppose the practice of home teaching will be confronted, and this is the myth of socialization. For a better examination of the work, the dialectical method will be used, which proposes to arrive at a conclusion from the arguments presented. In addition, the present study aims to highlight the importance of education in the Democratic State of Law, to question the constitutional duty of the State to provide education, to expose the modality of home teaching and to verify the extent to which there is compatibility between homeschooling and the duty of the State to provide education. | pt_BR |
| dc.description.resumo | O presente trabalho tem como objetivo realizar um estudo acerca do ensino doméstico, também conhecido como homeschooling, e seu possível reconhecimento legal no Ordenamento Jurídico brasileiro. Far-se-á uma investigação acerca da origem da educação no Brasil e uma breve análise do tratamento que ela recebeu nas constituições brasileiras e na atual legislação infraordinária, bem como examinar-se-á a natureza de direito social inerente à educação. Após, realizar-se-á um apurado a respeito do homeschooling no Direito norte-americano, bem como da base histórica e cultural que permitiu que o ensino doméstico florescesse no referido país. Por fim, enfrentar-se-á o principal argumento utilizado por aqueles que são contrários à prática do ensino domiciliar, sendo este o mito da socialização. Para melhor esquadrinhamento do trabalho, utilizar-se-á o método dialético, o qual se propõe a chegar a uma conclusão a partir dos argumentos apresentados. Além disso, o presente estudo tem como objetivos ressaltar a importância da educação no Estado Democrático de Direito, questionar o dever constitucional do Estado de fornecer educação, expor a modalidade do ensino domiciliar e verificar em que medida há compatibilidade entre homeschooling e o dever do Estado de fornecer educação. | pt_BR |
