dc.description.abstract	This paper aims at analyzing the right to health before the concepts of subjective rights, human rights and fundamental rights, within the context of contemporary society, which has been much burdened with wthical conflicts, and then face the problem of the limits of theright to health and the problem of paternalistic measures of the State concerning the individual. So the main focus is not really the right to health, but the conflict between the power or deciding how a person should act and the right to self determination, which is considered by many to be the distinctive character of our humanity.	pt_BR
dc.description.resumo	O objeto aqui é situar o direito à saúde diante dos conceitos de direitos subjetivos, direitos humanos e direitos fundamentais, no contexto de uma sociedade carregada de conflitos éticos como a contemporânea, para depois colocar o problema das limitações do direito à saúde e o problema das atitudes paternalistas da sociedade e do Estado diante do indivíduo. O foco principal não é então o direito à saúde, mas sim o poder de um ser humano decidir como o outro deve agir versus o problema da autodeterminação, para muitos a nota distintiva de nossa humanidade.	pt_BR
