Inversão do ônus da prova nas ações coletivas trabalhistas

Abstract

The principle of equality is enshrined in the Federal Constitution of 1988 in many WAYS, for example, in Article 5. However, when there is the factual situation in the labor courts in which parties can also participate in the formation of the conviction of the court, it appears that the inequality of the parties is still evident in individual demands, but in collective actions, this inequality decreases, but there are situations which the taking of evidence in collective actions is almost impossible due to the difficulties imposed by the employer. Thus, APPROACH to examine in this study, the possibility of reversing the burden of proof in labor collective action, taking as a basis the effectiveness of the constitutional principles of equality, access to justice and due process
