Violência digital e o dever fundamental de proteção de crianças e adolescentes: O julgamento do Recurso Especial Nº 1.783.269/MG no Superior Tribunal de Justiça

Abstract

This is a study on the fundamental duty of protecting minors in cases of digital violence. This article analyzes whether or not application providers on the World Wide Web (Internet) should wait for a court order to remove offensive material in cases of digital violence against children and adolescents. The article presents the understanding contained in a judgment handed down by the Superior Court of Justice in the judgment of Special Appeal 1.783.269/MG, which analyzed a case in which the image of a minor was exposed next to his father, accused of committing crimes of serious nature. The problem involves the role of Internet providers in the integral protection of minors in light of the Constitution and the Statute of Children and Adolescents, imposing on society the duty to care for the dignity of minors in the face of an omission on the part of the social network provider.
